Privacy Consent

This Privacy Consent applies to all individuals (in whatever capacity) dealing with Axiis Capital Pty Ltd ACN 639 996 259 AFSL 523464 and its related bodies corporate (Investment Manager). It also applies to individuals dealing with AMAL Trustees Pty Limited ACN 609 737 064 AFSL 483459 in its capacity as trustee of the Axiis Capital Mortgage Fund (Trustee). In this Privacy Consent, references to ‘we’, ‘us’ and ‘our’ refers to the Investment Manager and the Trustee jointly and severally.

Capitalized words in this Privacy Consent have the same meaning as in the Axiis Capital Privacy Policy, which is incorporated into this Privacy Consent and is available at www.we.money.

By acknowledging this Privacy Consent, you understand and agree that

  • this Privacy Consent incorporates all provisions of the Axiis Capital

Privacy Policy and you consent to those terms and conditions.

  • we may collect, use, hold and disclose your Personal Information for the purposes set out in the Axiis Capital Privacy Policy, including but not limited to:

  • Assessing your application for one of our products,
  • Arranging or providing one of our products or services to you,
  • Managing your relationship with us,
  • Direct marketing of products and services by us, and
  • Complying with all laws;

  • We may disclose Personal Information about you to:

  • Any persons who assist us to provide our products to you;
  • Financial consultants, accountants, lawyers and advisers;
  • Any industry body, tribunal, court or otherwise in connection with
  • any complaint regarding the approval or management of our provision of our products and services to you;
  • Trade insurers;
  • Any person where we are required by law to do so;
  • Any of our associates, related entities or contractors;
  • Your referees, such as your employer, to verify the information you have provided; and
  • Any person considering acquiring an interest in our business or assets.

You specifically understand and acknowledge that some of our third-party suppliers are located in countries outside of Australia and some may be located in countries that do not have laws that provide the same level of protection as the laws of Australia.

You also consent to us using and disclosing your Personal Information to any organization assisting us to verify your identity for the purposes of obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006, including the disclosure of your Personal Information (such as your name, date of birth and address) to:

  • Any on-line identification verification provider;
  • A CRB to obtain an assessment of whether that information matches information held by the CRB. The CRB may give us a report on that assessment and to do so may use information about you and other individuals in their files; and
  • To an approved Gateway Service Provider (GSP) to enable us to verify your identity using the Australian Government’s Document Verification Service (DVS). The GSP may give us a report on that assessment and to do so, may use information about you and other individuals held in official records. Any ORH used by us is a third party and is not related to the Investment Manager or the Trustee.

For the avoidance of doubt we note that alternative means of verifying you are available on request. If we are unable to verify your identity using information held by one of the above means, we will provide you with a notice to that effect and give you the opportunity verify your identity using an alternative method acceptable to us.

If you do not provide us with the consents in this Privacy Consent or provide us with your Personal Information we may not be able to arrange finance for you or provide other services.
